The following terms and conditions apply to all orders via our online shop.
Some conditions of the GTC only apply to you if you are a consumer within the meaning of Section 13 of the German Civil Code (BGB). You are a consumer if the purchase of the products cannot be attributed primarily to your commercial or self-employed professional activity. In each individual case, we expressly point out the limited validity of the regulation.
The purchase contract is concluded with Manufakturwerk GmbH.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation email.
A binding contract can also be formed beforehand as follows:
If you have chosen to pay by credit card, the contract is concluded at the time the credit card is charged.
If you have chosen the PayPal payment method, the contract is concluded at the time you confirm the payment order to PayPal.
If you have chosen the SOFORT transfer payment method, the contract comes into effect when the payment order to SOFORT GmbH is confirmed.
The languages available for the conclusion of the contract are German and English.

In addition to the stated product prices, shipping costs may also apply. (You can find out more about the amount of shipping costs in the offers.) We process incoming orders within 48 hours on weekdays and then ship them with Deutsche Post, DPD, UPS or FedEx. Our standard shipping takes a total of 2 to 5 days within the EU and 6 to 8 days outside the EU (if the product is in stock).
In the EU, shipping is offered to the following countries: Belgium, Bulgaria, Denmark, Germany, Estonia, Finland, France, Greece, Great Britain, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, the Netherlands, Austria , Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary. We also ship our products to most countries outside the EU.

Your credit card will be charged upon completion of the order.
PayPal
You pay the invoice amount via the online provider PayPal. You must be registered there or register first, identify yourself with your access data and confirm the payment order to us. You will receive further information during the ordering process.
Klarna invoice
Our partner Klarna only accepts the payment method invoice for orders from the following countries: Germany, the Netherlands and Austria. You will receive the payment information separately from our partner Klarna by e-mail.
SOFORT Banking
We also offer IMMEDIATE transfer. Herewith we receive the transfer credit immediately. This accelerates the entire order process. All you need is the account number, bank code, PIN and TAN. Using the secure payment form of SOFORT GmbH, which is not accessible to retailers, SOFORT transfer automatically and in real time places a transfer in your online bank account. The purchase amount is transferred immediately and directly to the retailer's bank account. If you choose the SOFORT transfer payment method, a pre-filled form opens at the end of the ordering process. This already contains our bank account. In addition, the transfer amount and purpose are already displayed in the form. You now have to select the country where you have your online banking account and enter the bank code. The goods remain our property until they have been paid for in full.
If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or transport insurance.
Right of withdrawal
Within the EU, you have the right to withdraw from this contract a) the Manufakturwerk GmbH products within 30 days and b) all other products within 30 days without giving a reason. The cancellation period is 30 days from the day on you or a third party designated by you who is not the carrier took possession of the goods. In order to exercise your right of withdrawal, you must send us (Manufakturwerk GmbH, Shanghaiallee 8, 20457 Hamburg info@manufakturwerk.de) a clear statement (e.g. a letter sent by post, fax or e-mail) about your decision to cancel this to revoke the contract. You can use the attached sample revocation form for this, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the notification of exercising your right of cancellation before the cancellation period has expired.
Consequence of resignation
If you should withdraw from this contract, we will refund all payments made by you. This will be done without undue delay and in any case no later than 14 days after receipt of the goods you have returned or proof that you have sent the goods back to us. The cost of the first delivery is excluded from the refund. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. We bear the costs of returning the goods within the EU. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exemption from the right of withdrawal
The right of withdrawal does not apply in the following cases: A) The delivery of non-prefabricated goods that is based on an individual request or the individual decision of the consumer or the goods are clearly personalised. B) The delivery of sealed goods that were opened after delivery and are therefore no longer approved for return for health and hygiene reasons.

Unless otherwise expressly agreed below, the statutory right to liability for defects applies
In the case of used items, the limitation period for claims for defects is one year from delivery of the goods.
The above restrictions and shortening of deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agentsin the event of injury to life, limb or health in the event of intentional or grossly negligent breach of duty as well as Malice in the breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations) within the framework of a guarantee promise, insofar as the scope of application of the Product Liability Act is compatible.

Manufakturwerk GmbH is not liable for defects in the goods that are solely due to the fact that you have stored the goods incorrectly or inappropriately. The provision of § 477 BGB remains unaffected, i.e. if you are a consumer and such a defect becomes apparent within six months after the transfer of risk, i.e. after the goods have been delivered to you or you have defaulted on acceptance (§ 446 BGB), we must prove that the defect is due to your incorrect or inappropriate storage of the goods. If we are not able to do this or if the cause of the defective condition or the time at which this cause occurred remains unclear, the presumption in your favor that the defect was already present at the time of delivery or the delay in acceptance occurred. This does not apply if the assumption is incompatible with the type of goods or the defect.
Manufakturwerk is also not responsible for damage to watches where the bracelet or the spring bar has come loose. No liability is assumed for bracelets that have become stuck in the Apple Watch, for example. We are always fully liable for claims based on damage caused by us, our legal representatives or vicarious agents
in the event of injury to life, limb or health,
if the cause of the damage is due to intentional or grossly negligent behavior,
to the extent of a guarantee we have assumed,
in the case of fraudulent concealment of defects, as well as
as far as the area of application of the Product Liability Act is open.
For slight negligence on our part, our legal representatives or vicarious agents, we are only liable in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner can regularly rely (cardinal obligations). In this case, our liability is limited to the damage foreseeable at the time the contract was concluded (value of the goods in the order), the occurrence of which must typically be expected.
In all other respects, our liability - also for vicarious agents - is excluded.
We do not accept any liability for third-party goods sent in, e.g. clasps or watches from other manufacturers.
